Vitorino Presents Private Copying Recommendations
António Vitorino, former European Commissioner for Justice and Home Affairs, in a mediation process on private copying levies, has presented his Recommendations to Internal Market Commissioner Barnier. Vitorino recommended two main streams of action.
First, he proposed to foster increased reliance on licences and contractual arrangements as the best way to ensure that right holders are properly remunerated for their creative efforts and investments. In addition, he recommended measures aimed at reconciling disparate national levy systems within the Single Market.
"The final aim, in my view, should be twofold: to foster tailor-made licensing agreements which allow creators to be remunerated directly, and to reconcile the existing, diverging national levy systems and the principles of the Internal Market. I am also convinced that levy systems must be transparent, more understandable and legitimate for consumers and all concerned operators alike," he said.
"ICMP strongly supports the principle of fair compensation to rightsholders for harm caused by mass private copying of protected works, as recognised by the EU. This compensation is a significant source of income for composers, lyricists, publishers and other rightsholders, particularly where sustainable business models of online content are still developing," said ICMP Director General, Ger Hatton.
ICMP is one of the stakeholders involved in the mediation process.
