POLICE SEIZE ILLEGAL ONLINE MUSIC DISTRIBUTOR
INTERNET: BIG STRIKE AGAINST ON LINE MUSIC PIRACY Milan, 20th of November - The Italian Fiscal Police and the FPM have raided an important national ISP in Asti, North West of Italy. The provider was offering a massive download of MP3s through the site www.mp3gas.com, hosted on the company servers. The investigation has been started a couple of weeks before the raid, when, during the regular net monitoring, FPM became aware of this large infringement. After some basic investigations and after having collected intelligence on the provider and the service it was offering, FPM got in touch with the Fiscal Police and the judges and set up the raid. FPM also participated to the operation as technical support on behalf of the Police Forces. The system implemented by the company was very effective and complicated both under the technical and commercial point of view. The virtual customer could sign a contract for a duration of 1,2 or 3 months having then the possibility of an unlimited number of downloads rather the “buy” a single MP3 file at the cost of 1,5 Euro. Real promotional sales were provided; for example it was possible to buy a so-called “compilation” made up of 15 songs at the special rate of 5 Euros. The download service payment had to be accomplished with credit card or wire transfer. Under the technical point of view the system was very clever. The company provided an archive of more than 12.000 music files hosted on the local servers. This archive contained all the latest releases as well as the most famous repertoire songs of the major Italian and international artists. If the customer could not find the requested song in this archive, the system automatically rerouted the client to the most infamous file sharing communities like Gnutella and Morpheus. The raid ended with the following results: - 12.579 MP3s files sold without any rights payment to the recording companies and to the artists have been seized - 1 entire server has been seized - The legal representative of the company has been criminally prosecuted for infringement of the Italian copyright law - The company will be charged with an administrative sanction of more than 250.000.000 ITL (more than 125.000 US$). In Italy music piracy represents 25% of the global music market with revenues losses for 180 millions US$ for the legitimate industry. Since September 2000 Italy has implemented a new Copyright law. The new law includes higher penalties for musical copyright infringement with imprisonment up to 4 years and administrative sanctions for hundreds of thousands of US$.
